1. Introduction

Shinymetrics is an application which allows you to understand how your website is used.

Shinymetrics is owned and operated by Opifex Sàrl, c/o RISTER Sàrl, Rue Adrien-Lachenal 26, 1207 Geneva (hereafter “we”, “us”).

To allow you, as a customer (hereafter “you”), to use Shinymetrics, we process personal data about you and act as Data Controller. This Privacy Policy explains how and why we process your data, as well as your choices in this regard, in compliance with applicable data protection laws.

This Privacy Policy does not apply to the personal data relating to the users of your website which is collected via Shinymetrics.

2. What personal data do we process and why?

To use Shinymetrics, an account is required. When you create an account, we ask you to provide a unique username, a password, your first and last name, the name of the company you work for (if applicable) and a billing address. You can also voluntarily communicate more information to us.

When you use Shinymetrics, we also collect the data about how you use this application.

We use this personal data to provide our services to you, to interact with you and answer your questions. We can also use your personal data to send you newsletters unless you have objected to it.

This processing is justified by the performance of the contract between you and us, our legitimate interests to improve our services and, regarding personal data that you voluntarily communicate, your consent.

3. Data sharing

We may share your personal data with those who provide us with services (in particular data hosting) as data processors. Our data processors are bound by an obligation of confidentiality and are entitled to use your personal data only in accordance with our instructions and this Policy.

When allowed or required by law, when it is necessary to defend our interests or with your consent, we may share your personal data with third parties, for example at the request of judicial authorities, to assert our rights in court or to allow you access to third party services.

4. Transfer abroad

Your personal data is stored in Switzerland Germany and France. All of these countries’ data protection legislation provide an adequate level of protection.

5. Retention

As a rule, we may retain your personal data up to two years since the termination of your account, unless a legal obligation obliges us to retain the data for a longer period of time.

If your personal data is processed exclusively with your consent, we may process your data during a short period of time after your consent’s withdrawal (in order to follow-up your request) and to keep a record of your request.

Anonymous information is not personal data and may be kept without any limitation.

6. Security

We use standard technology and security precautions, rules and other procedures to protect your personal data from unauthorized access, improper use, disclosure, loss or destruction.

7. Your rights

You are entitled to inquire about the personal data that we hold about you, and to receive a copy thereof, as well as to request an update, rectification, deletion and minimization of the processing of your personal data. You may at any time withdraw your consent and have the right to object to the processing of your personal data, unless a legitimate interest justifying the data processing exists. You also have the right to data portability regarding the data that you have transmitted to us and that are processed with your consent or for the performance of a contract. Additionally, you may refuse any use of your personal data by us for marketing purposes.

8. Amendments

We may update this Privacy Policy from time to time without notice. We will aim to bring any significant changes to your attention. Your continued use of Shinymetrics after any changes to this Privacy Policy will be regarded as acceptance of it.
